This page is provided for those contemplating doing business with Attention to Detail Training Limited (ATD) or their managing director, Rennie Garcia or his newer company, Futures Capital. It was created by Alta Plana Corporation (AP), which was contracted by ATD to provide training services. It documents our experience and provides related information we discovered in the course of pursuing actions to collect money owed by ATD to AP that included dunning letters, court suits, and steps to wind up ATD that were necessary and ultimately successful.
AP offers no opinion or recommendation whether anyone should or should not do business with ATD Training or Rennie Garcia. We aim simply to provide purely factual information and documentation to inform others' decisions.
ATD Training contracted AP to develop and deliver specialized training at the United Kingdom's Office for National Statistics. Contract Schedule 1, Schedule 2, and Schedule 3 cover a break-down of the overall training into three courses and require payment of a total of £800 due on schedule acceptance - ATD signed the schedules on April 5 2004 - of £2000 due on April 21 2004, and of £2000 due on April 29 2004. There were no contractual contingencies nor invoice requirements on which payments depended. AP's Grimes delivered the training in Newport, Gwent, Wales April 27-30 2004 to the satisfaction of the ONS.
ATD Training did not honor any of their contractual payment obligations. Instead, ATD's Rennie Garcia made repeated assertions that payment was made but no funds were received. Here's April 15 e-mail where Garcia says ATD would be making payment of £800 then overdue. Here's April 21-22 e-mail wherein ATD says "bill payment has been completed a [sic] will reach your account in the next few days." Here's a May 4 exchange where Rennie Garcia writes "I have authorised a wired transfer today consisting of the following payments [of £5508.21]" that would take 4 days to clear. One might conclude that Garcia had "authorised" the payment without actually initiating it with the bank. In that exchange, Garcia also wrote "Well done for producing some very good results in the allotted time allocated to some quite intense subjects." And he promised that "Once we receive your formal expense statement I will immediately authorise a payment for them." Given ATD's default, as a last step before filing suit, AP wrote ATD on May 12 requesting payment documentation and even called Rennie Garcia on his mobile phone and left a voicemail message. Garcia belatedly replied on May 13 saying "Let me check with accounts, confirm the exact date of the transfer and I'll come back to you." That report never arrived.
After repeatedly, unsuccessfully dunning Managing Director Rennie Garcia and staffer Nicola Stone by e-mail and telephone, AP filed suit. AP filed money claim 4QZ18185 for course fees in Northampton County Court on May 12 2004 and money claim 4QZ20260 for course expenses in the same court on May 27 2004. Northhampton County Court issued judgments upholding AP's first claim on June 16 2004 and upholding AP's second claim on June 30 2004. Both judgments were accompanied by court payment orders. Payment was nonetheless not forthcoming so AP initiated steps to wind up ATD Training as insolvent, abandoned once we received payment in full on July 15 2004.
While delinquent payments were still outstanding, AP had conducted extensive research to find information that would help in our effort to collect money owed us by ATD. We discovered several other consultants and companies that had had payment difficulties with ATD. Computer Resources Group, an ATD creditor, went so far as to file a court petition to wind up Attention to Detail Training Limited. (We were informed by solicitor Brian Connolly that ATD had settled on terms he declined to disclose.) The managing director of Universal Rental of London, Mark Welcome, told us in May that his company had won a "large" court judgment against ATD. (We will provide contact details on request.) Here is an e-mail exchange with one UK company and a second e-mail exchange with an ATD-contracted trainer. (Both e-mail threads are posted here with permission.)
